On a mention being made by the learned counsel for the appellant, the present case has been taken up today.

Learned counsel for the appellants submits that yesterday the appellants deposited Rs. 8.50 lacs with the respondent-bank and Rs. 8.50 lacs has already been deposited before this Tribunal, which may be released in favour of the respondentBank as per the request of the learned counsel for the Bank. Learned counsel for the appellant further states that the property in question is a residential accommodation, in which the appellants reside, but the Bank is going to auction the same today, therefore, it is prayed that the interest of the appellant may be protected.

Learned counsel for the respondent-Bank contends that if the application is received from the appellant for payment of amount, which remains due, the same shall be considered and dues payable may be duly intimated to the appellants for payment.

In view of the aforesaid, the amount deposited by the appellant towards pre-deposit along with interest accrued thereupon is directed to be released in favour of the respondent-Bank within fortnight from today and the auction of the property in question, which is fixed today, shall be deferred from today subject to deposit the amount, failing which the Bank shall be free to proceed further in accordance with law.
