Heard the learned counsel for the appellant on the urgency application being I.A. No. 417/2025 as well as the withdrawal application being I.A. No. 416/2025.
Learned counsel for the appellant submits that the matter has been settled between the parties under OTS, therefore, the appeal may be dismissed as withdrawn. It is further prayed that the amount of Rs. 33.00 lacs deposited by the appellant towards pre-deposit may be released in favour of the respondent-Equitas Small Finance Bank Ltd.
The aforesaid averment has not been disputed by the learned counsel for the respondent-Bank and states that the matter has been settled between the parties.
In view of the above, the present appeal is dismissed as withdrawn and the amount deposited by the appellant towards pre-deposit along with interest accrued thereupon is directed to be released in favour of the respondent-Equitas Small Finance Bank Ltd. within fortnight from today.
