The matter is taken up for hearing by way of a Praecipe filed by the Petitioriers/Appellants for seeking urgent relief.
This Application is filed for refund of the pre-deposit, deposited at the time of entertaining the Misc. Appeal Dy. No. 586/2025.
Learned Counsel for Petitioners/Appellants submitted that the Petitioners/Appellants have settled the loan amount with the Bank, and therefore, they are seeking permission to withdraw this Misc. Appeal and also refund. •
Learned Counsel for Respondent Bank submitted that still
there is some amount remains to be paid by the Petitioners/Appellants and they may be asked to pay that amount also.
In the said circumstances stated by Learned Counsel appearing for the parties, the Petitioners/Appellants want to withdraw this Misc. Appeal along with refund, this Tribunal, taking note of the fact that Petitioners/Appellants settled the loan amount with the Bank, they are permitted to withdraw the Misc. Appeal.
The Registry, DRAT, Mumbai, is directed to refund the pre deposit amount along with accrued interest, if any.
