When the matter is taken up, it is submitted by Ld. Counsel for the appellants that matter has been amicably settled with the respondent bank and the appellants wants to withdraw this appeal and filed an application i.e., IA No.498/2025 for withdrawal of this appeal and also wants to file a separate application for refund of pre-deposit.
In reply, Ld. Counsel for respondent bank that matter is not settled so far, however, negotiations are going on between the appellants and the bank and he has no serious objection for withdrawing the appeal by the appellants.
Whatever be the case, when the appellants want to withdraw this appeal as they are prepared to settle the issue with the bank, this Tribunal is of the view that appellants can be permitted to withdraw this appeal. Accordingly, permission is accorded and IA 498/2025 is allowed.
Misc. Appeal 89/2023 is dismissed as withdrawn. Pending lAs, if any stand closed.
In view of the dismissal of the appeal as withdrawn. Registry is directed to refund the pre-deposit made while entertaining this appeal, to the appellants with accrued interest if any.
