LA. No. 504/2025 filed for seeking stay was dismissed on the ground that the secured asset was mortgaged in the year of 2011, but the Petitioner/Appellant purchased the mortgaged property in 2022. The Petitioner/Appellant purchased the property on his own risk when the mortgage was in force. Therefore, interim stay cannot be granted. Against that order, this Appeal is filed. It is the submission of Learned Counsel for Petitioner/Appellant that Petitioner/Appellant purchased this property from his vendor on 22.08.2022. His vendor, in turn purchased this property, on 29.03..2017. Though the personal guarantor, said to have purchased the property on 30.11.2005, his name is not entered in the revenuerevenue record. Thus, Petitioner/Appellant is a bonafide purchaser. Now the Respondent Bank is trying to take possession, therefore, this Appeal. Learned Counsel for Respondent Institution opposes this Application on the ground that Mr. Abhijit Bapurao Dudhane purchased this property from 1) Smt.
