no illegality in the measures adopted by the respondent bank under SARFAESI Act and dismissed the aforesaid IA, which was filed for Mumbai. By the said order, Ld. Presiding Officer found that there is stay. Against the order of dismissal, this appeal is filed. This appeal is filed against the order dated 9.1.2023 passed in IA 2800/2022 in SA No.280/2022 on the file of DRT-III, Vashi, Navi

It is seen that this appeal is pending from the year 2024. Since this appeal is filed only against an interim order declining grant of stay, this Tribunal is of the view that this appeal can be disposed of by directing the Ld. Presiding Officer, DRT-III, Vashi, Navi Mumbai to disposed of SA No.280/2022, as expeditiously as possible.

Accordingly, Ld. Presiding Officer, DRT, III, Vashi, Navi Mumbai is and in accordance with law. However, there shall be an order of directed to dispose of SA No.280/2022, as expeditiously as possible from today. It is open to the Learned Presiding Officer to decide on stay of taking possession of the property, for a period of one month the continuation of stay order, on the basis of need and exigency.

In the result, Misc. Appeal No.3/2024 is disposed of, with the above direction. Parties are directed to bear their own costs.
