The. matter is taken up for hearing by way of a Praecipe filed by thc Petitioner/Appellant Bank for seeking urgent relief.

This Application is filed for extension of status quo order which was granted, by Leariicd Chairperson, DRAT, Mumbai bn 24.01.2025 in I.A., .No, 08/2025 (stay) -in Regular Appeal No. 01/2025. Learned Counsel for Petitioner/Appellant Bank submitted that in S.A. No.200/2022 before DRT-Aurdngabadj .Learned Presiding Officer,. DRT-Aurangabad set aside the sale' though the sale was heid followingithe mcasurcs.. Against that, Appeal Nd. 01/2025 was filed. When the .matter was listed on 11.02.2025 from 24.61.*2025, the status quo order already granted on 24:01.2025 was riot extended. From 11.02.2025, the matter was adjourned to 16.04.2025, Since thfite was ho regular Chairperson, DRAT, 'Mumbai, available, the matter was not listed for extension of stay and it was listed in regular board. Taking advantage of non-extension of status quo order, the borrower'Respondent Nos.l arid 2 arc trying to delete the name of the Bank.from the revenue records by subfnittirig ah application to the Revenue Authority. Unless, the Stahrs quo prder grahted oh 24.0J.2025 is extended, .the Bank's interest would seriously be prejudiced in the event ofaucceeding in the main Appeal. Learned Counsel for Respondents submitted that on 24.01.2025, the status quo was ordered for the reason that ho
reply was filed. On 16.04.2025, the reply was filed, but, no Request was made for extension of status quo order. He ‘wants to get instructions with regard to any change that had taken place after status quo order was passed on 24.01.2025. In the light of the submissions made by teamed Counsel for parties and the alleged effort taken by borrowers to remove the name of Bank, from the revenue records, this Tribunal is of the view that, it is necessary to extend the status quo order, which was passed on 24.01.2025 to be continued, till the disposal of the Stay application. Accordingly, this application is ordered. List the case on 31.07.2025 for hearing.
