This application is filed for substitution of Respondent No.l. It is the submission of the Ld. Counsel for petitioners/appellants that the 1“ respondent Sammaan Capital Limited has assigned the loan concerned to this proceeding to Omkara Assets Reconstruction Private Limited. Therefore, the amendment is necessitated.

Ld. Counsel for 1“ respondent institution confirms the assignment of loan from Sammaan Capital Limited to Orhkara Assets Reconstruction and reported no objection ih allowing this application.

From the submissions of Ld. Counsel for petitioners and first respondent, it is seen that debt in question has been assigned by first respondent Le., Sammaan Capital Limited in favour of Omkara Assets Reconstruction Private Limited.

In the said . circumstances, substitution of Omkara Assets Reconstruction Private Limited in place of Sammaan Capital Limited is absolutely necessary. Therefore, this amendment application is allowed in so far as the substitution of Omkara Assets Reconstruction Private Limited in place of Sammaan Capital Limited is concerned.

Petitioners are directed to carry out necessary amendment and file amended Appeal memo by next date of hearing.

List the matter on 21.5.2025 for further hearing.
