Heard the learned counsels for the parties.
Learned counsel for the appellant submits that the property in question has already been auctioned and there remains nothing to be decided before this Tribunal. Learned counsel further submits that since the matter is pending before the Tribunal below, therefore, the matter may be remanded back before the Tribunal below with the direction to decide the pending securitization application within the time as stipulated by this Tribunal, to which the learned counsel for the respondent-F.I. has no objection.
As prayed by the learned counsels for the parties, let the matter be remanded back to the Tribunal below for fresh adjudication of the matter, which is stated to be pending, in accordance with law, without being influenced by the finding recorded in the order impugned, most expeditiously, preferably within three months from the date of production of certified copy of this order.
In view of the above, the present appeal is finally disposed off.
