Appeal Dy. No. 567/2024 Date: 06.06.2024
M/s Vidushi Stone Crusher and 2 Ors. Vs. Bank of Baroda
Present: Shri S. K. Gupta, counsel for the appellants, None for the respondent-Bank,
Heard the learned counsel for the appellants.
The present appeal has been filed by the appellant against the interlocutory order dated 08.04.2024, by which the interim application filed by the appellant has been dismissed by the Tribunal below.
It appears that the possession of the property in question has been taken by the authority concerned pursuant to the order passed by the Hon’ble High Court, which has been taken into consideration by the Tribunal below while passing the order impugned. It is not disputed that the S.A. filed by the appellant is still pending consideration and the stay application has been heard before the Tribunal below, in which order has been reserved. As such there remains nothing to be decided in the present case. Therefore, the present appeal stands disposed off.
