On a mention being made by the learned counsel for the appellant that the respondent-Bank is going to take physical possession of the property in question, the present case has been taken up today.
Shri Maneesh Mehrotra, Advocate, who was requested by the Board to appear in the present case on behalf of the Bank, after taking instruction from Shri B. P. Mishra, who was the counsel in the case before the Tribunal below and who has informed that the Bank is not going to take physical possession of the property in question today and if the possession is taken, at least 15 days’ prior notice shall be given by the Bank to the appellant.
In view of the above, the appeal stands disposed off.
