The matter is taken up for hearing by way of a praecipe filed by the appellants for seeking urgent relief.
This is an application filed by the appellants for a refund of the pre-deposit made by them to entertain this appeal. The appeal was dismissed for noncompliance with the payment of the entire predeposit and now the appellants seek a refund of the part payment made by them together with the accrued interest.
Notice was served on the respondent but none appears to oppose this application. There is no attachment or lien over the amount and therefore, the application is allowed and the amount together with accrued interest shall be released to appellant No.2 on proper acknowledgement.
