The matter is taken up for hearing by way of a praecipe filed by the Appellant for seeking urgent relief.
The Ld. Counsel appearing for the Respondent bank submits that no bidders have come forward for the intended sale which is to take place tomorrow i.e. 23.02.2024, and therefore, the sale is not likely to move ahead.
The Ld. Counsel appearing for the Appellant submits that the pre-deposit has already been made and the further auction of the property may be stalled till the disposal of the appeal.
The said prayer can be considered in the appeal and appropriated. The immediate threat of the property being auctioned is no longer in place. Hence, the appeal is adjourned to 23.04.2024 for a hearing.
