It is submitted that the Ld. Counsel appearing for the respondents that Sarfaesi measures have been dropped in view of the settlement arrived between the borrowers.
The appellant is 3rd party who claimed to the bonafide purchaser. In view of the Sarfaesi measures being dropped, the S.A. will not be maintainable any more.
Hence, the appeal has also become infructuous.
The appellant is at liberty to seek remedy against the borrowers if any.
