Hdfc Bank Limited versus Rohan Dyes and Intermediates Private Limited

This is an application for the stay of the operation of the impugned order dismissing O.A. No. 163/2012 on the file of the Debts Recovery Tribunal-I, Ahmedabad (D.R.T). The operation of this dismissal order is sought to be stayed as several connected matters are pending before various forums and the respondents are taking advantage of the dismissal in those proceedings. Such an application stay cannot be allowed at this interlocutory stage of admission of the appeal.

The Ld. Counsel appearing for the Appellant has submitted that the impugned order is perverse and there are so many directions and observations which are prima facie not acceptable. The Ld. Counsel appearing for the Respondent submits that no stay of the operation of dismissal order can be passed by this Tribunal. I find substance in that submission of the Ld. Counsel appearing for the
