The Appellants are in appeal aggrieved by the order of the Debts Recovery Tribunal-II, Ahmedabad (D.R.T.) wherein the prayer of the Appellants for an early hearing of the interlocutory application was posted today for hearing. Whereas there was a sale which was scheduled to take place yesterday.
The Ld. Counsel appearing for the Respondent Bank submits that the sale failed for want of bidders and therefore, a fresh notice will have to be issued for selling the property.
The D.R.T is at liberty to hear the application for interlocutory reliefs.
Given this fact, the appeal has become infructuous and hence, it is disposed of.
