THE APPELLATE TRIBUNAL :
Heard learned counsel for the appellant and respondent no.1 and perused the records.
This is an application seeking transfer of Appeal No.2 of 2018 pending before the learned DRT-II Kolkata to any other DRT.
This is an old appeal of 2018. Post of Presiding Officer, DRTII Kolkata is lying vacant for quite a long time. Presiding Officer was posted there, but he has not joined. Since 1st of September, 2023 even the charge of DRT-II Kolkata has not been assigned to any other Presiding Officer by the competent authority. Earlier charge of Presiding Officer, DRT-II Kolkata was assigned to the Presiding Officer, DRT-Siliguri, which was expired on 31.08.2023.
In such circumstances, it would be in the interest of justice, let the matter be transferred to other DRT for disposal. Transfer

Petition No.1 of 2023 is allowed. Accordingly, Appeal no.2 of 2018 pending before DRT-II Kolkata is recalled and transferred to Presiding Officer, DRT-I Kolkata for disposal in accordance with law. No costs.
File be consigned to record room.
Copy of the order be supplied to the appellant and the respondents and a copy be also forwarded to the concerned DRT.
Copy of the judgement/Final Order be uploaded in the Tribunal’s website.
