Shri Ashok Pandey, Ld. Counsel for the appellant-Auction Purchaser is present. All defects except the defect regarding deficit court fee is reconciled. As regards the defect that there is deficiency of court fee of Rs. 12,425/-, Ld. Counsel states that the relief sought is to set aside or modify the order passed by Presiding Officer, DRT, Patna and compute and ward compensation in terms of section 19 of the SARFESI Act. Ld. Counsel prays to place the matter before Hon’ble Court and he will argue the issue of Court fee before Hon’ble Court.
The instant Appeal has been filed under section 18 of the SARFAESI Act against final order dated 22.12.2022 of DRT, Patna in S.A. No. 27/2021. Urgency Application (I.A. No. 58/2023) has been filed along with the Appeal.
