Learned counsel for the appellant has drawn attention of this court to the I.A. No. 942/2023, whereby the orders of the Hon’ble High Court as well as the Hon’ble Apex Court have been appended to bring the same on record and direction has been issued by the Hon’ble Apex Court vide order dated 03.11.2023 in SLP No. 12061/2023 to this Appellate Tribunal to decide the appeal, which has been appended as annexure no. 6 of the aforesaid I.A.
Learned counsel for the respondent-Auction Purchaser states that he does not want to file any reply because he is not necessary party as the matter pertains to the O.A. No. 163/2020 and no relief has been claimed by the appellant against him in the present case. Therefore, his name may be deleted.
As prayed, list this case on 29.11.2023.
