No Representation from Appellants. Since Vakalath purported to have been filed on behalf of Appellants is not proper & not in order.
- Uploading of all pleadings in e-DRT portal is mandatory as per GSR No. 79 (E) Notification Dtd. 31.1.2023 which stipulates that “e-filing of pleadings by applicants is mandatory and any other form of filing shall not be taken on record”.
- Further after doing e-filing, hard copies are to be filed within 7 days as per instructions of Notification No. GSR 43 (E) Dtd. 22.1.2020.
- It is observed that uploading of clean copy of Appeal, purported vakalth etc. are not still carried out by Appellant despite sufficient time and opportunities given on 3/4/2023, 12/4/2023, 20/4/2023, 8/5/2023, 18/5/2023, 23/5/2023, 5/6/2023 and Today.
- Accordingly Appeal is declined in terms of Rule 6 (4) of the DRAT (Procedure) Rules, 1994 as defects have not been rectified in reasonable time.
