As per the Appeal the appellants are the owner of the property. The predecessor of the appellant were the actual owner of the property and had executed a registered lease deed in favour of Muradabad Spinning and Weaving Mills. Company Ltd. The property was mortgaged by Muradabad Sintex Ltd. by playing fraud upon the appellant in connivance with the financial institution i.e. IFCI (Para 5.24 and 5.29 of the instant appeal).
The instant Appeal has been filed under section 18 of the SARFAESI Act against final order dated 14.10.2022 of DRT, Dehradun in S.A. No. 106/2021.
