Condition of pre-deposit has not been made by the appellant. As per the notice dated 15.06.2017 under section 13(2), the outstanding amount was Rs. 1,90,72,085/-. A Waiver Application has been filed by the appellant submitting that after issuance of the demand notice and before issuance of the sale notice dated 06.04.2023, they have deposited Rs. 98.00 lakh approx which is more than 35% amount of the outstanding and prayed for waiving the condition of pre-deposit.
The sale notice dated 06.04.2023 at page No. 135/136 shows the outstanding amount of Rs. 2,65,42,560/- as on 28.03.2023.
The present appeal has been filed under section 18 of the SARFAESI Act against the interim order dated 08.05.2023 passed by DRT, Jabalpur in S.A. No. 368/2023. Urgency Application (I.A. No. 387/2023) and Waiver Application (I.A. No. 388/2023) has also been filed.
