Shri V.K. Shukla, holding brief of Shri K. Kartikey, Ld. Counsel for the appellant is present and files certified copy of the impugned order. Ld. Counsel also removed other defects. Defects reconciled. Proper court fee paid.
No pre deposit has been made. Waiver Application has been filed. As per the Sale Notice dated 06.03.2021 (page 57 of instant Appeal) dues of the Bank was Rs. 5,21,55,751 + interest. It has been stated in Para 5 of Waiver Application that the appellants had deposited Rs. 2,31,79,160/- from the date of NPA 21.06.2019 to 30.04.2022. Ld. Counsel states that he will argue this issue before Hon’ble Court.
The instant Appeal has been filed under section 18 of the SARFAESI Act against interim order dated 22.11.2022 of DRT, Allahabad in S.A. No. 219/2021. Urgency Application (I.A. No. 727/2022) and Waiver Application (I.A. No. 728/2022) have been filed along with the Appeal.
