Regarding Waiver Ld. Counsel have submitted that after issuance of the Demand Notice the Appellant have deposited Rs. 38,00,000/- and 39,92,530/- on different dates which is more than the 25% of the outstanding of Rs. 2,35,30,941.67/- as per demand Notice dated 11/10/2021.

It is further submitted by the Appellant in his Stay Application that in compliance of the order passed by the Tribunal below, he has further deposited 12,00,000/- with the respondent Bank on 25/03/2023. Deposit slip are annexed with the Stay Application.

The present appeal has been filed under section 18 of the SARFAESI Act against the interim order dated 09.05.2023 passed by DRT, Jabalpur in S. A. No. 214/2023. Waiver Application (I.A. No. 422/2023), Expedite Application (I.A. No. 546/2023) and Stay Application (I.A. No. 547/2023) have been filed.
