The registry has punted out a deficiency of Rs. 1750/- towards the court fee. Ld. Counsel for the appellant has submitted that in the present appeal appellants have paid fee on the basis of amount mentioned in the notice under section 13(2) dated 22.12.2014 of the SARFAESI Act 2002 (page No. 74) of the appeal and the office has wrongly pointed out deficiency of court fee, as per the amount mentioned in the sale notice dated 16.04.2018 (page No. 180). He has further submitted that the same fee has been paid before the Tribunal below and prayed for placing the case before Hon’ble Court and shall argue the same before the Hon’ble Court.

The waiver Application being I.A. No. has also been filed for non deposit of 50% of the outstanding amount on the grounds that

The instant Appeal has been filed under section 18 of the SARFAESI Act against final order dated 18.02.2021 passed by DRT, Dehradun in S.A. No. 35/2018. Appellant has also filed Delay Condonation Application and Exemption Application has been filed.

List this case before Hon’ble Chairperson on 15.03.2023 for admission.
