IN THE DEBTS RECOVERY APPELLATE TRIBUNAL AT KOLKATA
Diary No. 200 of 2019
THE HON’BLE MR. JUSTICE ANIL KUMAR SRIVASTAVA CHAIRPERSON
05.06.2023 Rushnlo Kemp ... Appellant -VsVijaya Bank .. Respondent
Mr. Kamlesh Jha with Ms. Srabani Biswas, Learned Counsel for the Appellant
Mr. Santosh Kumar Ray with Ms. Sonal Agarwal, Learned Counsel for Respondent
THE APPELLATE TRIBUNAL :
During the course of hearing, Learned Counsel for the Appellant prays for not pressing the relief No. 1 of the appeal and also endorses the same on the relief portion of the appeal.
As far as relief no. 2 is concerned there is an application for condonation of delay, being I.A. 544 of 2019. Record shows that the certified copy of the impugned order is not filed by the Appellant. Appeal is not maintainable without the certified copy. However, it appears that Registry has ignored this fact. In future, Registry should be cautious enough while accepting the records.
Learned Counsel for the Appellant prays for and is granted a week’s time to file the certified copy of the impugned order.
