THE APPELLATE TRIBUNAL :
This appeal was filed on 01.10.2019. Service was effected upon the Respondent vide order dated 14.02.2020. Thereafter time was granted to the Respondent continuously for filing the opposition. But the same was not filed. Despite the order dated 28.06.2023, opposition is not filed. It shows the conduct of the Respondent to keep the matter pending on one or the other pretext. Today again Learned Counsel for the Respondent sought time to file the opposition on his personal ground that he could not enter the correct date in his diary. This only reflects upon the conduct and demeaner of the Respondent. A last opportunity of seven days is granted to the Respondent to file the opposition with copy to the Appellant who may file the rejoinder within a week thereafter. It is made clear that if the opposition is not filed within 7 days from today,

opportunity of filing the opposition shall stand closed. Rejoinder if any, be filed within two weeks.
List on 18th September, 2023 for hearing of appeal.
