The parties have entered into a compromise and the parties have filed consent terms. The appeal is to be withdrawn with the S.A. pending before the Debts Recovery Tribunal-I, Mumbai (D.R.T.).
The Appellants had made a pre-deposit of ₹1,18,35,000/- and it is agreed mutually by the parties that the said amount with the accrued interest shall be returned to the first Respondent as per the terms of the settlement. Hence, the appeal is disposed of as withdrawn recording the terms of settlement and the amount in deposit with the Registry shall be returned to the first Respondent together with accrued interest on due acknowledgement.
All Miscellaneous Applications, if any, are dismissed as infructuous.
