Heard the learned counsel for the appellant in part.
Learned counsel for the appellant submits that in the proceedings of the suit filed by the appellant, decree was passed, which has attained finality from the stage of the Hon’ble High Court in the second appeal and without disclosing the same, the Bank has initiated the proceedings by instituting the suit at Hapur, which was subsequently transferred to the DRT, Jabalpur and thereafter, to DRT, Allahabad and then ultimately to DRT, Lucknow. The learned counsel further submits that the appellant kept on appearing till DRT, Allahabad and thereafter, he could not appear before the DRT, Lucknow, as the brother of the appellant lost his interest in the case and the appellant did not know about it. Thus the order impugned has been passed. However, the learned counsel for the appellant prays for time to prepare and argue the case.
