THE APPELLATE TRIBUNAL :

Respondent Nos. 1 and 2 may file the objections against I.A. No. 260 of 2023 and 258 of 2023 within a week. On the next date of listing Learned Counsel for the Appellant should also make submission about the maintainability of the Appeal as proceedings are pending before the Recovery Officer who has passed the different orders. He should also submit as to whether those orders were challenged or not? If so, result thereof. It is made clear that the order dated 13^th July, 2023 shall remain in force till the next date of listing which is quoted as under:

“List on 19^th July, 2023 for disposal of I.A. No. 258 of 2023 and I.A. No. 260 of 2023. This order in no way be treated as a stay of proceedings pending either before the DRT or the Recovery Officer. Registry should communicate this order to the concerned DRT forthwith.”
