This matter has been taken up by me through Video Conferencing.
Ld. Counsel for respondent Fl has given an offer on instruction from respondent Fl that in case the appellant pays cost and expenses of Rs.1.00 lac, the respondent Fl is ready to delete his name from array of the respondents in the O.A. and R.C.
Ld. Counsel for appellant on instruction accepts the said offer and ready to deposit Rs.1.00 lac by tomorrow i.e. 24.02.2023 towards cost and legal expenses.
Accordingly, the name of Mr. Punit Bhargava be deleted from O.A. and R.C. The respondent FI, however, is at liberty to proceed against the other respondents in accordance with law. This order has been passed with consent of both parties.
With the above direction, the present appeal is disposed of.
