This application is filed seeking refund of pre-deposit amount.
Advocate for appellant submitted that property was already sold, amount realized, surplus amount also paid to the appellant and there is no liability to the R1 bank. It is further submitted that Appeal RA (SA) 37/2020 is dismissed on 27.12.2022 and appellant is entitled for refund of statutory deposit made as per orders of this Tribunal dated 10.1.2020 in IA 446/2018 (Waiver).
As per endorsement made by Office, there is no attachment against this amount.
Considering the reasons stated in the affidavit, application is allowed as prayed for and Registry shall refund the deposited amount with accrued interest, if any.
