Heard the learned counsel for the appellant.
Learned counsel for the appellant states that the order impugned has been passed without considering the fact that the M.A., which was filed against the order of the Tribunal, was barred by time apart from the other ground, which was taken by the appellant in the objection to the M.A. No. 174/2022, copy of which has been appended as annexure no. 6 of the paper book. It is further contended that without condoning the delay, the order impugned has been passed, which is not sustainable in the eye of law.
Issue notice to the respondents by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
List this case on 26.05.2023 for service.
