Shiv Shakti Communications and Ors. versus Hdfc Bank Ltd.

Learned counsel for the appellants states that she has made 25% predeposit. She further states that she has also served the advance notice of the appeal upon the respondnet bank through e-mail. Learned counsel for the appelant submits that the possession of the property is scheduled to be taken at 12.30 p.m. today through the Receiver Ms. Shreya Gupta. She also submits that the appellants are ready to settle the matter and pay the amount due.

The bank was contacted telephonically, but no one has appeared on behalf of the bank.

Heard. In the circumstances, Ms. Shreya Gupta, the Receiver is directed not to take possession of the property today. However, in case this appellate Tribunal comes to the conclusion that the appeal is not maintainable, the bank can take the possession of the property through the same Receiver.

Let the Receiver and the bank be informed of this order accordingly by the counsel for the appellant.

List the matter for 06.02.2023 for hearing on the application for waiver of the balance pre-depsoit (I.A. No.68/2023). In the meanwhile, let notice of this application be issued to the respondent bank.
