months from the date of order. On 14.04.2006, the Respondents issued a cheque dated 09.10.2006, drawn on Indusind Bank, Bandra branch for ₹5 lakhs towards part payment of their liability to the Applicant/Appellant. The original Applicant United Western Bank Ltd. amalgamated with the present Appellant, namely IDBI Bank Ltd. The cheque issued by the respondents was dishonoured and a notice of dishonour was issued to the Respondents. On 31.10.2006, the Respondents issued a fresh cheque for ₹5 lakhs on condition that the notice is withdrawn. The Appellant filed in Misc. Application Ext.54 for the amendment of the cause title in consequence of the amalgamation, and issuance of a Recovery Certificate because of the breach of the earlier order dated 10.04.2006. The substitution was allowed but the prayer to issue a Recovery Certificate for ₹65,89,325.21 was disallowed and instead, a Recovery Certificate as per order dated 10.04.2006 minus ₹5 lakhs paid on 31.10.2006 was directed to be issued by the D.R.T. on 26.09.2008. However, the office of the D.R.T. issued a Recovery Certificate for ₹65,89,325.21 with interest minus ₹5 lakhs paid on 31.10.2006 was issued.
