THE APPELLATE TRIBUNAL :

This is an appeal against an order dated 06.12.2022 passed by Ld. DRT-2 Hyderabad in S.A. No. 269 of 2022 whereby the substitution application was allowed. Appeal is admitted. Let regular appeal number be provided. Learned Counsel for the Appellant submits that the SARFAESI Application has been allowed on certain grounds which have been pleaded in the pleadings. Rather they were raised on the date of final hearing. Having gone through the pleadings I find substance in the submission of the Learned Counsel for the Appellant. Notices be issued to the Respondents. Respondent may file the opposition within four weeks with copy to the Appellant who may file rejoinder within two weeks thereafter. Till the next date of hearing, operation of the impugned order shall remain stayed.
