Heard the learned counsel for the applicant on the urgency application being I.A. No. 483/2023.
For the reason stated in the urgency application, the same is allowed and the date fixed for 14.07.2023 is preponed today.
Learned counsel for the respondent-Borrower submits that he shall deposit the demand draft for Rs. 55.00 lacs with the appellant-F.I. as the matter has been compromised. Let the demand draft be given to the appellant-F.I. by the respondent-borrower and appropriate application be filed before the Tribunal below to decide the S.A. in accordance with law.
In view of the above, the appeal stands disposed off with direction upon the Tribunal below to consider and decide the S.A. No. 602/2021 in accordance with law most expeditiously.
