Present: Shri D. N. Awasthi, counsel for the appellants, Shri Sandeep Arora, counsel for the respondent-Bank,
Learned counsel for the appellant submits that he is an auction purchaser. Since the Bank does not have the possession of the property, which was auctioned, therefore, he wants to money back with interest, which has not been done. Learned counsel further states that in the auction notice, the encumbrance on the property was not shown by the bank, therefore, it is contravention of provision of law and the appeal may be allowed with costs.
Learned counsel for the respondent-bank submits that his reply has been filed, to which the learned counsel for the appellant does not want to file any rejoinder as limited issue is involved in the present case.
In view of the above, list this case for hearing on 19.04.2024.
