THE APPELLATE TRIBUNAL :

Learned counsel for the appellant prays for an adjournment of the matter on the ground that notice could not be served upon the respondent in compliance of the order dated 21.03.2023.

Matter could not be argued today. Perusal of records will show that waiver application is pending. Impugned order was passed by learned DRT on 31.03.2008 wherein it is recorded that loan was taken on 31.12.1998 since then about 25 years have passed. It only shows the intention of the appellant that he is interested only to lingering of the proceeding for one or the other ground. Record further shows that in compliance of the order of the Hon’ble Calcutta High Court being CO No. 1663 of 2081 dated 05.02.2018 proceeding was kept in abeyance thereafter Registry submitted report dated 17.02.2023 wherein notices were issued to the parties for appearance.
