Learned Counsel for appellant, Sh. Sanjay Kumar Gupta, has filed Recall Application (I.A. No. 719/2023) along with Rs. 15.00 Lakhs vide DD No. 015825 dated 27.07.2023 of Rs. 5.00 Lakhs, DD No. 012327 dated 04.9.2023 of Rs. 5.00 Lakhs and DD No. 464972 dated 05.09.2023 of Rs. 5.00 Lakhs towards pre-deposit praying that the order dated 30.05.2023 be recalled because no waiver is required as the said amount is more than 50% of the demand raised by the bank.
In view of the above, let the recall application be placed before the Hon’ble Court on 18.09.2023 for orders.
Ld. Counsel is directed to supply a copy of the said Application and intimate the date fixed to the opposite parties.
