This is an application for early hearing filed by the appellant on the ground that recovery proceedings had been initiated by the RO-II in RC No.8/2021 in O.A. No. 558/2017.
Ld. Counsel for appellant states that appellant had deposited Rs.2,18,00,000/- towards the 25% of pre-deposit in compliance of the order dated 22.09.2022 and if the respondent is not restrained from proceeding with recovery of amount, irreparable loss will be caused to the appellant.
Issue notice on the application to the respondent by all permissible modes for 09.02.2023 the date already fixed.
