The matter is taken up for hearing by way of praecipe dated 10.02.2023 filed by the Appellant seeking urgent relief.
It is reported that Respondent No. 4 has died and an application was filed yesterday by the Appellant for bringing on record the legal representatives of the deceased fourth Respondent. There is also an application filed for condonation of delay and setting aside abatement, if any, in bringing the legal representatives of Respondent on record.
The applications have not yet been numbered. The same shall be numbered and posted before the bench for a hearing.
Notice shall be issued to the concerned parties including the proposed legal representatives to be impleaded if the applications are numbered and the appeal shall be heard afresh.
