THE APPELLATE TRIBUNAL :
This appeal is connected with Appeal No. 78 of 2023. It appears that Respondent No. 4 in this appeal is Appellant in Appeal No. 78 of 2023. Respondents No. 2 and 3 are also parties in Appeal No. 78 of 2023 who are represented through Counsel. It is relevant to note that both the appeals have arisen out of the same order. Submission of the Learned Counsel for Respondents No. 2 and 3 in this appeal that they have no instruction to appear in this appeal has no substance when the appeal is arising out of the same order in which they have made their appearance. This is a dilatory tactics being adopted by Respondents No. 2 and 3 which cannot be accepted. Accordingly, notice of I.A. 276 of 2023 is held sufficient.
