This matter has been taken up by me through Video Conferencing.
Pre-deposit has not been made by the appellants. Ld. counsel for respondents 2 and 3 has referred to the judgment of the Hon’ble Supreme Court in the case of M/s Sidha Neelkanth Pap er Industries Pvt. Limited Vs. Prudent ARC Limited & Ors. [Civil Appeal No.8969 of 2022 decided on 05.01.2022] and submitted that appellants have to make pre-deposit. Learned counsel for the appellants prays for time to seek instruction from his client on this aspect.
Heard. At present the file be consigned to record room and be revived as soon the appellants make the pre-deposit within a period of four weeks and files an application for revival of the appeal.
