THE APPELLATE TRIBUNAL :
Matter is taken up. At the very outset a request is made from the Respondents that the matter may either be adjourned or passed over as the Learned Counsel for Respondent is busy before the Hon’ble High Court.
It is pertinent to mention that this matter was taken up on a put up application on the 4th of August, 2023 wherein an order of the Hon’ble High Court was annexed passed in C.O. 2477 of 2023 (Dinesh Agarwal -vs- Fullerton India Home Finance Limited & 3 Others) wherein the Hon’ble High Court expected the Appellate Tribunal to hear out the stay application and dispose of the same within 7th of August, 2023. The Hon’ble High Court passed this order on 27th August, 2023 but for the reasons best known to the Appellant the order was not placed before this Tribunal on 1st August, 2023 when the matter was taken up for hearing.
