Heard the learned counsel for the appellant.
The present appeal has been filed under section 18 of the SARFAESI Act against the final order dated 03.07.2023 passed by the DRT, Jabalpur in S.A. No. 664/2022.
The report of the Registrar dated 14.07.2023 shows that the urgency application being I.A. No. 561/2023, waiver application being I.A. No. 560/2023 and Stay application being I.A. No. 559/2023 have been filed. The said report further shows that the appellant has deposited a sum of Rs. 16.00 lacs through demand drafts toward pre-deposit. Let the said amount be kept in the form of FDR in the nationalized Bank for a period of one year in auto renewal scheme.
Since the matter has been taken up today, therefore the urgency application being I.A. No. 561/2023 has become infructuous and is disposed off as such.
Shri Ashish Malhotra, Advocate holding brief of Shri A. K. Srivastava, Advocate submits that Shri A. K. Srivastava will appear on behalf of the respondent-Bank, therefore, the matter may be taken up tomorrow i.e. 19.07.2023. Learned counsel for the appellant is directed to serve the copy of memo upon the counsel for the respondent-Bank during course of the day.
