Ld. Counsel for the appellant Shri Manoj Kumar Dubey is present.
Regarding pre-deposit Ld. Counsel for the appellant submitted a affidavit dated 18.12.2023 in support of defects pointed out by Registry. Vide this affidavit Ld. Counsel for the appellant stated that the appellant has made a pre-deposit of 31.6% of the RC amount of Rs. 1,57,95,844/- in instant appeal which is more than the minimum of 25% as required in terms of mandatory pre-deposit u/s 21 of RDB Act 1993. Ld. Counsel for the appellant also urged that, the present affidavit may be read as an explanation in support of Interim Application dated 14.08.2023 for dispensation from deposit of amount of debt due in on filing appeal u/s 21 of the RDB Act 1993 and objection of registry is treated as satisfied.
Waiver Application (I.A. No. 670/2023) has also been filed by the appellant Counsel.
