Heard the learned counsels for the parties.

Learned counsel for the respondent-Bank has brought on record a copy of order dated 19.06.2023 passed by the Tribunal below and has stated that since the property has been de-locked and the entire amount is to be deposited within two months by the borrower as mentioned in the order itself of the Tribunal below. Therefore, it is contended that the appeal filed against the interim order has become infructuous.

Learned counsel for the appellant agrees to the contention as raised by the counsel for the respondent-Bank.

In view of the above and the fact that since the matter has been settled between the parties, therefore, the appeal has become infructuous. Accordingly, the appeal is dismissed as having become infructuous. No order as to costs.
