Received a Misc. Application being No. 673 of 2023 through online on 26/09/2023 and hard copy on 08/11/2023 with Application fee of Rs.250/vide Transaction Ref. No. 2609230020578 dt. 26.09.2023 filed by Ld. Advocate Ms. Mitul Chakraborty for Sri Partha Banerjee, Applicant with a request to pass an order for refund of amount of Rs.88,000/- (Rupees eighty thousand only) deposited by the Appellant as pre-deposit.

Affidavit of service is filed through online on 10/10/2023 and hard copy on 08/11/2023. Postal tracking report has been annexed with the affidavit of service showing that service has been deemed to be confirmed upon Ld. Counsel Mr. Soudip Pal Chowdhuri appearing for Respondent bank only.

Vide order dated 09/08/2023 in Appeal No. 97 of 2023 passed by Hon’ble Chairperson the appeal was dismissed.

It is to mention that in compliance of the order dated 28/03/2023 passed by Hon’ble Chairperson, Appellant deposited of an amount of Rs.88,000/(Rupees eighty eight thousand only) as pre deposit on 19/04/2023 vide DD No. 304938 dated 19/04/2023 and the said DD was deposited to Indian Bank, Dharamtolla Street, 5. C.R. Avenue, Kolkata – 100072 on 20.04.2023 for making fixed deposit. Indian Bank issued a TDR No. T21/MTDE 0123457, Account No. 7488091072 of the said amount for period of one year w.e.f. 24.04.2023.
