Counsel for the appellant removes the defects by mentioning the Pin Code No. of parties and providing certified copy of the order with regard to defects No. 2 and 3, he submits that affidavit along with Waiver Application is not required, as the application for Waiver is a part of pleadings of the main appeal and with regard to defect No. 3, he will argue before the Hon’ble Court as pre-deposit as property has been auctioned for more than demand raised by the Bank, in the last he prays that the case be listed before the Hon’ble Chairperson .
On view of the aforesaid, let the case be listed on 02.03.2023 before the Hon’ble Chairperson for admission/pre-deposit.
